Contractual Agreement between SIMPLY SUPERB FOODS hereinafter called CATERER/CONSULTANT

Performance of this agreement is contingent upon the ability of the CATERER/CONSULTANT to complete the same and is subject to labor troubles, disputes, strikes, accidents, government ( federal, provincial and municipal ) requirements, restrictions upon travel, transportation, food, beverages, supplies, cooperation from owner and or management and/or other causes whether enumerated herein or not, beyond control of the CATERER/CONSULTANT preventing or interfering with performance. In the event of such unusual weather conditions that local or provincial police agencies prohibit travel or public transportation of any kind, then the patron will be relieved of payment for guaranteed number of guests. Patron, however, is obligated to pay for any dated printed matter or such perishable items that have been specifically ordered for the affair. ( e.g. food, flowers, etc. )

All taxes federal, provincial or municipal applicable to this function shall be paid by the patron also a 15 % gratuity or less may be added to prices herein agreed upon (some exceptions may apply)

Any liabilities deriving from the consumption of any food, beverages, alcohol or any other causes whether enumerated herein or not at this establishment or any function location the PATRON remains solely responsible regardless of the involvement or not of CATERER/CONSULTANT.

The CATERER/CONSULTANT will supply the PATRON for his approval with a written detailed requirements and expectations ( including designs, recipes, menus ETC. ) which will be followed by the CATERER/CONSULTANT to the best of his ability and good conscience, (not compromising safety, law and standards) of the CATERER/CONSULTANT.

If liquor is to be served by the CATERER/CONSULTANT the CATERER/CONSULTANT will exercise all reasonable care in security of liquor supplied by patron and will furnish (if so agreed upon) to dispense such liquor. However, the patron will not hold CATERER/CONSULTANT liable if theft, breakage or vandalism should occur or other acts beyond reasonable care by CATERER/CONSULTANT.

Patron agrees to begin function promptly at the scheduled time and to vacate premises at the closing hour indicated. By same the patron further agrees to reimburse to the caterer for overtime wage payments or / and any other expenses incurred by the CATERER/CONSULTANT because of patron's failure to comply with these regulations and agreement.

If any prearranged details must be altered after the contract is signed the CATERER/CONSULTANT and the PATRON will do his best to attempt to accommodates any such changes, but not enforceable unless in writhing and signed by both parties.

Patron assumes responsibility for any and all damages caused by any guests, invitee, or other person attending the function.

Patron agrees to reimburse the CATERER/CONSULTANT for any extra meals requested for orchestra, entertainers, security, etc. enumerated herein or not.

It is understood that patron will conduct function in an orderly manner and in full compliance with all applicable laws, ordinances, regulations and any special requirements of renter if set forth in contract.

If any prearranged details must be altered after the contract is signed the CATERER/CONSULTANT will do his best to attempt to accommodate any such changes, but cannot guarantee the alteration, and therefore, will not be liable .

A 40% deposit is required at the time of signing this contract ( refundable within one week except any expenses paid towards the function ). 50% is to be paid one month prior the function at which time all details are finalized and the final 10% shall be paid by the end of the function.

  Interpretation, presentation or preparation of any and all items concerning ( food, drinks, service and staff ) served at this establishment or any function involving the CATERER/CONSULTANT is obeyed and is contingent upon the expertise and the discretion of the CATERER/CONSULTANT, unless otherwise specified in writing by the PATRON and signed by both parties.

The CATERER/CONSULTANT caterer reserve the right to make reasonable substitution if unable to secure specified items.

Patron agrees to supply CATERER/CONSULTANT caterer with guaranteed guests numbers a seating and a floor plan at least two weeks prior to the affair.

This contract is voidable only in writing with one MONTH notice with no explanation necessary (The deposit is only fully refundable in the first 2 weeks if function is cancelled by the PATRON and fully refundable at any time if function is canceled by the CATERER/CONSULTANT.
